Began discussing the bylaws – wording, specifics.

  • Pet rules
    • Authority already present to amend rules & regulations
    • Limit max # of pets in household? Typical with condo housing, not so much with townhomes. Best to have Fairfax County to enforce their laws.
    • Include pet cleanup rules in bylaws? Can be reported to Fairfax County. Can send a letter to homeowner to remind about pet pickup and that County enforcement may get involved.
    • Question why HOA Board does not have authority to issue fine for pet cleanups but does have authority for parking violations. Authority is provided in the Virginia Property Owner’s Association Act. Fines for pets would need to have to amend the Deed of Declaration.
    • May be best to post reminders to website, to include flyers with mailing notices with reminders. Review Management Company contract and how they can be more engaged.

    • Take to court for conjunctive relief to compel owner to fix home
    • Why does Reston Assoc not care about it?
    • If owner is found to be in contempt, then charge owner of cost of repairs.
    • Must give owner appropriate amount of time to act for each violation

  • Electric Vehicles
    • HOA Board can prohibit installation of EV Charging stations
    • Fairfax County prohibits electric cables crossing sidewalks – trip hazard
    • Owners would need to get easement to install a proper charger for EV
      • This would involve demolition the sidewalk, installing the charger and relaying the sidewalk to match cluster sidewalks.
